Dealing with Construction Disputes
One way the courts try to make things easier when it comes to Construction Disputes is by using Pre-action Protocols. These are guidelines that set out the steps parties should take before going to court. There’s a specific Protocol for Construction and Engineering Disputes. It’s designed to encourage parties to share information early on and try to resolve issues without going to court.
Here’s how the Pre-Action Protocol works:
- You send a detailed letter explaining the issue.
- The other party has to reply within 14 days.
- They then send a detailed response (and maybe a counterclaim) within 28 days.
- You reply to their counterclaim (if any) within 28 days too.
- Then there’s a meeting to talk things out within 28 days.
- If things still aren’t sorted, you might have to go to court or try mediation.
Following the Protocol can save time and money. It involves sending a detailed letter explaining your claim, then waiting for a response from the other party. If things still aren’t sorted, there’s a meeting to try to work things out. If all else fails, then court proceedings might be necessary.
