Birth Injury / Cerebral Palsy
The TSP Clinical Negligence team has recently settled a case which involved the birth of twins in December 2000. Unfortunately Baby Q, the Claimant twin, was born with quadriplegic cerebral palsy resulting in significant spasticity to all four limbs, significantly reduced vision, trunk and head control and the inability to walk.
Baby Q’s injuries are permanent and she will never be able to work or live independently. The allegations against the Trust involved in her birth were that they failed to interpret correctly a Cardiotocograph trace which was suspicious and that, had her situation been reviewed by a Registrar, there would have been a decision to deliver the twins earlier than was otherwise the case, and that if she had been delivered in a timely manner she would have avoided all or most of her subsequent injuries.
The Defendants denied liability. The matter proceeded to a round table meeting. A settlement of £2.5million was agreed.
